LITIGATION

Are you being sued in Texas? Do you need to sue someone? Most litigation follows a similar pattern, even when the facts can be very different. The case starts with a petition, where the plaintiff explains what the defendant did wrong. It is followed by an answer, where the defendant denies that they did anything wrong. The parties generally engage in discovery – requests for information, requests for document, requests to admit. Some cases also have depositions of one or more of the principals. After depositions, one (or sometimes both) parties will move to have the court resolve the case. If those motions fail, some cases can be resolved in mediation. A very few cases actually go to hearing. There are usually briefs and reply briefs at the end of the hearing.
