Program Description<\/strong><br \/>\nBy opting into the Company\u2019s mobile messaging service, the Client agrees to receive recurring [promotional\/transactional\/conversational] text messages from us. These messages may include [appointment reminders, order updates, customer support, or marketing alerts].<\/p>\n<p><strong>2. Consent &amp; Opt-In<\/strong><br \/>\nConsent is not a condition of purchase. By providing your (the Client\u2019s) phone number and checking the opt-in box on the Company\u2019s website, you (the Client) provide your express consent to receive messages via automated technology.<\/p>\n<p><strong>3. Message Frequency<\/strong><br \/>\nMessage frequency varies based on your interaction with the Company. The Client may receive varying messages per month, based on Company communication frequency.<\/p>\n<p><strong>4. Cost<\/strong><br \/>\nMessage and data rates may apply depending on the Client\u2019s mobile carrier\u2019s plan.<\/p>\n<p><strong>5. Opt-Out Instructions<\/strong><br \/>\nThe Client can cancel the SMS service at any time. Just text &#8220;STOP&#8221; to [dedicated phone number is <a href=\"tel:346-597-2191\">346-597-2191<\/a>]. After the Client sends the SMS message &#8220;STOP&#8221; to the Company, the Company will send the Client an SMS message to confirm that the Client has been unsubscribed. After this, the Client will no longer receive SMS messages from the Company unless the Client re-subscribes.<\/p>\n<p><strong>6. Support\/Help<\/strong><br \/>\nIf the Client is experiencing issues with the messaging program, the Client can reply with the keyword &#8220;HELP&#8221; for more assistance, or the Client can get help directly at <a href=\"mailto:joe@tx-scs.com\">joe@tx-scs.com<\/a>.<\/p>\n<p><strong>7. Carrier Disclaimer<\/strong><br \/>\nCarriers are not liable for delayed or undelivered messages.<\/p>\n<p><strong>8. Privacy Policy<\/strong><br \/>\nThe Clients use of the SMS service is also governed by the Company\u2019s Privacy Policy. All quotes are valid for 30 days, after which values may be subject to change.<\/p>\n<p>The Company shall perform a site assessment prior to any critter guard job initiation to confirm the following:<\/p>\n<p>&#8211; No bird nests present, or damage caused by rodents. Price is subject to change if animal nesting is found underneath specific arrays during time of installation, which may require additional bird nesting removal charges.<\/p>\n<p>&#8211; Severity of damage to wiring under array. If damage is found on panel wiring during the time of installation, the homeowner will be notified. However, the Company does not perform any electrical damage repairs. Any electrical repairs shall be performed by outside company and prior to critter guard installation.<\/p>\n<p>&#8211; Once the Client approves the quote, all material will be purchased by the Company. Once material arrives, The Company will contact the Client to schedule installation, based on availability.<\/p>\n<p><strong>Warranty:<\/strong><\/p>\n<p>The Company\u2019s workmanship warranty is valid for 1 year from date of installation. Product warranty of only the critter guard material is for the life of the photovoltaic (PV) system. The Company will make necessary repairs and\/or replacement without charge to the customer only for natural\/atmospheric degradation (i.e. natural breakdown, galvanic corrosion) to the material and\/or attachments. Product warranty does not cover any solar panels and\/or electrical related solar panel issues.<\/p>\n<p><strong>Modification Risks:<\/strong><\/p>\n<p>Any unauthorized modifications or repairs to the installed critter guard by third parties shall void workman ship warranty. If the Client has panel malfunctions that require any panel(s) to be removed\/replaced, removal of critter guard material is not covered under the warranty nor does it cover any damage to the critter guard material caused by third parties. The Company shall be contacted to temporarily remove critter guard material and attachments, however, additional removal\/installation charges will apply and new attachments shall be purchased by the Client, since not reusable. If original material cannot be reused, new material shall be replaced by the Client and new installation charges will apply.<\/p>\n<p><strong>No Guarantee of Prevention:<\/strong><\/p>\n<p>While the Critter Guard system is designed to deter birds, squirrels, and other rodents, it is not a 100% guarantee against all wildlife intrusions. Animals may still find entry points due to extreme persistence or is the system has panel gaps that can&#8217;t be covered by critter guard (i.e. spacing between each panel caused by original installation method that isn\u2019t modified prior to installation). Usually gaps under 1 inch is acceptable.<\/p>\n<p><strong>Property Damage Liability:<\/strong><\/p>\n<p>The company is not liable for any property damage, including chewed wiring, nesting, or roof damage, caused by wildlife regardless of whether a guard is installed.<\/p>\n<p><strong>Warranty Exclusions:<\/strong><\/p>\n<p>Most solar panel and equipment warranties exclude damage caused by pests. Professional installation of a guard typically does not void your system warranty, but the guard itself may not be covered under standard workmanship warranties.<\/p>\n<p><strong>Debris Accumulation:<\/strong><\/p>\n<p>Critter guards are designed to block animals, not small environmental debris like leaves or twigs. The homeowner is responsible for periodic cleaning to prevent fire hazards or airflow restrictions.<\/p>\n<p><strong>Limitation of Liability:<\/strong><\/p>\n<p>In no event shall the Company be liable for any incidental or consequential damages, including lost energy production or repair costs, resulting from animal activity.<\/p>\n<p><strong>Maintenance Required:<\/strong><\/p>\n<p>Critter guard may require regular inspection to ensure the material remains secure and have not been damaged by animals they are designed to keep out.[\/vc_column_text][vc_custom_heading text=&#8221;Solar Panel Cleaning Terms of Service&#8221; font_container=&#8221;tag:h2|font_size:28px|text_align:left|color:%23E19A55&#8243; use_theme_fonts=&#8221;yes&#8221; css=&#8221;&#8221;][vc_column_text css=&#8221;&#8221; woodmart_inline=&#8221;no&#8221; text_larger=&#8221;no&#8221;]This Agreement is made between TX Solar Cleaning Solutions (&#8220;Company&#8221;) and &#8220;Client&#8221; and for services at property owner\/address listed on this quote. Initial Assessment (Over the Phone)<\/strong><br \/>\nRoof pitch, total array quantity, and total panel count are typically based off the Clients inputs or aerial views. Verification of all inputs will occur by the Company during initial on-site visit and adjust final price, if applicable.<\/p>\n<p><strong>2. Scope of Work<\/strong><br \/>\nThe Company agrees to provide cleaning services for the solar panels located on the Client&#8217;s roof, including the removal of dirt, debris, and removal of bird droppings using eco-friendly, non-abrasive, deionized\/pure water methods.<\/p>\n<p><strong>3. Client Responsibilities<br \/>\n<\/strong><br \/>\n<strong>Water Source:<\/strong> The Client will ensure a functional, accessible water spigot is available. The Company will use the necessary volume of water from the Clients source for solar panel cleaning services to ensure the system if cleaning per the Companies requirements.<\/p>\n<p><strong>Access:<\/strong> The Client will ensure the roof is accessible and clear of pets or obstructions. The Client shall ensure no pets are loose in the work areas. The Client assumes full responsibility and liability for any injury, harm, or damage to the Company\u2019s staff caused by their pet(s)<\/p>\n<p><strong>4. Disclaimer of Warranties &amp; Liability<br \/>\n<\/strong><br \/>\n<strong>Pre-existing Conditions:<\/strong><br \/>\nThe Company is not responsible for damages existing before the cleaning, including micro-cracks, damaged panels, faulty wiring, or pre-existing roof leaks. All pre-existing damage will be documented, via photos, and the Client will be made aware prior to cleaning.<\/p>\n<p><strong>5. Cleaning Limitations<\/strong><br \/>\nExternal debris such as paint, varnish, lime scale, mastic, cement, mortar, glue, labels, or other building products cannot be removed by pure water alone. In certain cases accepted by the Company, removal of these types of external debris can be completed, at a separate cost. The Company provide standard solar panel cleanings and as such our pricing model does not factor (unless otherwise noted) for any paint scraping, stain or oxidation removal or any other issue. Please note that due to the nature of removing these types of debris normally what the Company terms as \u2018Builders Cleans\u2019 the Company can not guarantee that it is so ingrained into the glass that removal may cause a slight scratch. All due care will be taken to avoid this, however, the Company cannot be liable for any marks left post cleaning.<\/p>\n<p><strong>6. Energy Production<\/strong><br \/>\nWhile cleaning is intended to optimize efficiency, the Company makes no guarantees regarding specific increases in energy production.<\/p>\n<p><strong>7. Limitation of Liability<\/strong><br \/>\nThe Company shall not be liable for any indirect, incidental, or consequential damages. The Company\u2019s total liability is limited to the cost of the service provided.<\/p>\n<p><strong>8. Indemnification<\/strong><br \/>\nThe Client agrees to indemnify and hold harmless the Compnay, its employees, and agents from any claims, damages, or expenses arising from the Client&#8217;s negligence, such as improper system installation or pre-existing roof issues.<\/p>\n<p><strong>9. Scheduling &amp; Weather<\/strong><br \/>\nDue to the nature of roof work, the Company may need to reschedule due to high winds, rain, or excessive heat. The Company will provide a 4-hour window for arrival.<\/p>\n<p><strong>10. Payment &amp; Cancellation<\/strong><br \/>\nPayment, by the Client to The Company representative on site, is due upon job completion, or if agreed, an invoice can be sent to be paid within that same day. Cancellation of appointments within 24 hours of the scheduled service shall incur a fee of $125.00.<\/p>\n<p><strong>11. The Company will use the necessary volume of water from the Clients source for applicable cleaning services.<br \/>\nAccess: The Client will ensure work areas are accessible and clear of pets or obstructions. The Client shall ensure no pets are loose in the work areas. The Client assumes full responsibility and liability for any injury, harm, or damage to the Company\u2019s staff caused by their pet(s)<\/p>\n<p><strong>3. The Company will make every effort to clean surfaces to the best of their ability.<\/p>\n<p><strong>5. Limitation of Liability:<\/strong><br \/>\nThe Company shall not be liable for any indirect, incidental, or consequential damages.
